Terms of Service

These Terms of Service (“Terms”) govern your use of Authenticly, a privacy-first, pseudonymous tracker and research hub for people living with HSV-1 and HSV-2, operated by SamKis Labs (“Authenticly”, “we”, “us”). Please read them carefully — by using Authenticly you agree to them.

1. Acceptance of these terms

By creating an account or otherwise using Authenticly, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the service.

2. Eligibility

You must be 18 years of age or older to create an account or use Authenticly. By using the service you represent that you meet this requirement and that you are legally able to enter into these Terms.

3. Medical disclaimer — important

Authenticly is a self-tracking and informational tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. The dashboards, AI pattern insights, research summaries, and community content are for general information and personal tracking only. AI insights describe correlational patterns in your own data — they never establish that anything causes an outbreak, and they are not a substitute for professional judgement.

Always seek the advice of a qualified clinician for any questions about your health, symptoms, medication, or treatment. Never disregard or delay seeking professional medical advice because of something you read or recorded in Authenticly. If you think you may have a medical emergency, contact your local emergency services immediately.

4. Your account and responsibilities

You are responsible for keeping your login credentials secure and for all activity that happens under your account. You choose a pseudonymous alias rather than registering with your real name; please keep personal information (your own or anyone else’s) out of public areas such as the community. Notify us promptly if you believe your account has been accessed without your permission. The accuracy of the data you record is your responsibility.

5. Subscriptions, billing and cancellation

Authenticly offers a free tier and paid plans. Current paid options are Core Premium ($5.99/month or $49.99/year), Insights Pro ($9.99/month or $89.99/year), and a one-time Lifetime plan ($89). Prices are shown on the pricing page and may change from time to time; any change will apply to future billing periods, not retroactively.

Paid subscriptions are billed in advance through Stripe and renew automatically each period until cancelled. Your statement shows “SLABS” — never “Authenticly” or anything HSV-related. The Lifetime plan is a single payment with no recurring charge.

You can cancel at any time from the billing portal (reachable from your Profile or the pricing page). When you cancel a recurring plan, you keep access until the end of the period you have already paid for, and you are not charged again. There is no lock-in.

Cooling-off period. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have 14 days to cancel a new purchase of a digital service. However, Authenticly gives you immediate access to your subscription as soon as payment is taken. By subscribing, you expressly request that the service begins immediately and you acknowledge that you lose your 14-day right to cancel once that access has started. As a result, a subscription period that has already begun is not refundable, save where a refund is required by law.

Cancelling an auto-renewing plan. You can cancel a recurring subscription at any time from the billing portal (reachable from your Profile or the pricing page). When you cancel, you keep access until the end of the period you have already paid for, and you are not charged again — there is no lock-in. Part-used periods are non-refundable except where consumer law requires otherwise.

Billing errors. If you believe you have been charged in error, contact us at support@authenticly.co.uk and we will review it in good faith.

6. Acceptable use

You agree not to:

  • use Authenticly for any unlawful purpose or in breach of these Terms;
  • attempt to access another user’s account, data, or records;
  • probe, scan, disrupt, or circumvent the security of the service or its infrastructure;
  • scrape, harvest, or bulk-extract content, or attempt to re-identify pseudonymous users;
  • upload malicious code, or interfere with other users’ use of the service;
  • misuse the service in any way that could harm Authenticly or other users.

7. Community guidelines

The community is a pseudonymous peer-support space. By posting, you agree to be kind and supportive, to keep personal details (real names, locations, contact information) out of posts, and not to present anything as medical fact or advice. Content is moderated, and we may remove posts or restrict accounts that break these rules. You retain ownership of what you write but grant us the licence needed to display it within the service. Community content is peer support only and is not a substitute for professional medical advice.

8. Intellectual property

Authenticly, including its software, design, and content (excluding content you create), is owned by us and protected by intellectual-property laws. We grant you a limited, personal, non-transferable licence to use the service in accordance with these Terms. You keep ownership of the data and content you create.

9. Disclaimers

The service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose and that the service will be uninterrupted, error-free, or that any insight, summary, or research content is accurate or complete. Research summaries are generated from publicly available sources for informational purposes only, and we do not endorse any specific treatment, trial, or institution.

10. Limitation of liability

To the fullest extent permitted by law, Authenticly and SamKis Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence. Nothing in these Terms affects your statutory consumer rights.

11. Termination

You may stop using Authenticly and delete your account at any time (see the Privacy Policy for how your data is handled). We may suspend or terminate your access if you materially breach these Terms or use the service in a way that harms other users or the service itself.

12. Changes to these terms

We may update these Terms as the service evolves. When we make material changes, we will update the effective date above and, where appropriate, notify you. Continuing to use Authenticly after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of England and Wales, and the courts of that jurisdiction will have exclusive jurisdiction over any dispute, without affecting any mandatory consumer protections available to you where you live.
